Acceptance of Terms

Welcome to Mobile Golf Services (MGS). By accessing or using our websites, mobile applications, and related services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, please do not use our Services. These terms are built by www.021consulting.co

Eligibility

You must be at least 18 years of age to use our Services or have the express permission of a parent or legal guardian. By using our Services, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and abide by all of these Terms.

Rental Services and Booking

  1. Reservations: All reservations must be made through our authorized channels (website, phone, or email). Reservation requests are subject to availability.
  2. Payment: A valid credit card or other approved form of payment is required to secure your rental booking. Full or partial payment may be required at the time of booking (see Refund Policy below for more details).
  3. Rental Term: Rental periods are determined at the time of booking. Any extensions or modifications must be approved by MGS in advance and may incur additional fees.
  4. Customer Responsibilities:
    • Provide a safe, level, and suitable environment for the simulator setup.
    • Follow all instructions regarding the use and care of the golf simulator equipment.
    • Return the equipment in the same condition in which it was delivered, barring normal wear and tear.

Equipment Usage

  1. Damage to Equipment: Customers are responsible for any damage or loss to the simulator or associated equipment due to misuse, negligence, or intentional acts. MGS reserves the right to charge the customer for any necessary repair or replacement costs.
  2. Safety: Users of the golf simulator must follow all safety guidelines provided by MGS staff. MGS is not liable for any injuries sustained due to improper use of the equipment.
  3. Location Requirements: It is your responsibility to ensure the delivery location meets the space and power requirements for the simulator equipment.

Intellectual Property

All intellectual property related to the Services, including but not limited to logos, trademarks, service marks, images, and any related documentation, is the exclusive property of MGS or its licensors. You agree not to duplicate, sell, or use any of our intellectual property for commercial purposes without prior written consent.

User Conduct

You agree not to engage in any activity that:

  • Violates any applicable law or regulation.
  • Infringes upon any third party’s rights.
  • Attempts to gain unauthorized access to our systems or data.
  • Transmits any viruses or other malicious code.

Disclaimer of Warranties

Our Services, including the golf simulator equipment, are provided on an “as is” and “as available” basis without any warranties of any kind. MGS disclaims all warranties, whether express, implied, statutory, or otherwise, including, but not limited to, warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, MGS, its employees, affiliates, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, arising out of or in connection with your use of our Services.

Indemnification

You agree to defend, indemnify, and hold harmless MGS, its employees, affiliates, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

  1. Your use of and access to the Services.
  2. Your violation of any term of these Terms.
  3. Any injury or damage caused by your misuse of the golf simulator equipment.

Termination

We reserve the right to terminate or suspend your access to our Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Governing Law

These Terms and any dispute arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on our website with an updated “Effective Date.” Your continued use of our Services after any modifications indicates your acceptance of the new Terms.
